1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Cuimhne Code website, purchase of physical products, and access to our digital memorial platform. Cuimhne Code is a trading name of AGP Media Ltd, a company registered in Ireland ("we", "our", "us"). By using our services, you agree to these Terms. If you do not agree, please do not use the service.

2. Description of Service

Cuimhne Code provides physical QR code plaques and linked digital memorial pages. Customers ("Owners") can purchase a plaque, scan it to claim the unique URL, create a user account, and upload media and text to build a digital memorial. Visitors can view published memorials and, if enabled by the Owner, submit digital tributes.

3. Accounts & Claiming

To create a memorial, you must create an account and claim your physical plaque using its unique identifier. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process.

4. User Content & Responsibilities

You are solely responsible for any text, photographs, videos, or other materials ("Content") you upload to a memorial or submit as a tribute. You agree that:

• You own or have the necessary licenses, rights, and permissions to use and share the Content.
• The Content does not infringe on the intellectual property, privacy, or publicity rights of any third party.
• The Content is not unlawful, defamatory, abusive, offensive, or otherwise inappropriate for a memorial setting.

5. Content License & Moderation

You retain ownership of your Content. However, by uploading Content to Cuimhne Code, you grant AGP Media Ltd a worldwide, royalty-free, non-exclusive license to host, store, display, and distribute the Content for the purpose of operating and providing the digital memorial service.

AGP Media Ltd is not obligated to monitor all user-generated content but reserves the right, at our sole discretion, to remove, edit, or block any Content or memorial that violates these Terms or is deemed inappropriate, without prior notice.

6. Service Lifespan & Ongoing Access

Our goal is to host your digital memories securely for the long term. When we refer to "lifetime" or "ongoing" access in our marketing, this means the commercially reasonable lifespan of the Cuimhne Code service. It does not constitute a legally binding guarantee of perpetual, infinite hosting.

AGP Media Ltd reserves the right to modify, suspend, or discontinue the service (or any part thereof) if necessary due to business closure, significant technological shifts, or factors beyond our reasonable control. In such unlikely events, we will make reasonable efforts to provide users with advance notice and an opportunity to download their content.

7. Purchases, Shipping & Returns

Orders for physical plaques are subject to availability and our acceptance. Prices and shipping costs are displayed at checkout. Due to the personalized nature of linked QR plaques, returns or refunds are generally only accepted if the physical item arrives damaged or defective.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AGP Media Ltd shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of data, profits, or goodwill arising out of your use of or inability to use the service. Our total liability for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us for the specific product or service in question. The service is provided "as is" and "as available" without any warranties of any kind.

9. Termination

We reserve the right to suspend or terminate your account and access to the service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
